Plan Description
This is a proposed Redistricting Map for the Arizona Congressional Districts. Based on comments made by Commissioner Neuberg, I ignored the Commission Adopted Grid Map and substituted my map which is composed of actual grids and which recognizes mountain and desert areas as well as rural and urban areas with the addition of a Tucson area District. I call my Redistricting Map as “Ready for SECTION (14) F.”. It is intended to meet all of the requirements of SECTION (14) A. through SECTIONS (14) E. of PROPOSITION 106 with no effort to establish competitive Districts. I believe that it is a requirement of PROPOSITION 106 that such a map be prepared to optimize the requirements of SECTION (14) A. through SECTIONS (14) E. to establish a basis for “no significant detriment to the other goals” when making adjustments for competiveness.
Plan Objective
My map respects Native American Community boundaries, County Lines, and City and Town limits to the extent possible within population constraints. None of the 21 Native American Community are split and all are included in Districts one, two and three. My major concern is compliance with the Voting Rights Act which was passed to protect the rights of African-American voters which is not an issue in Arizona. I am unable to find a Supreme Court decision showing its applicability to Hispanic voters. (The closest is Abbott V. Perez which was based on African-American and Hispanic voters and provided no guidance as to the rights of Hispanic voters.) That the present Third District African-Americans who are the subject of the Voting Rights Act are complaining about their representation by a Hispanic Representative as recently reported in the Arizona Republic adds to the uncertainty.
